Effective: October 20, 2026
This privacy policy describes how Whitey Morgan Music, and the managers, partners, and agents working on our behalf, collect, use, and share data about you. It also describes your rights to control data about you. Legally speaking, Whitey Morgan Music is the “controller” of this data.
The disclosures in this privacy policy cover whiteymorgan.com (the official website of Whitey Morgan and the 78’s), our official merch store at whiteymorgan.myshopify.com (“Whitey Morgan Merch”), our email and text lists, and our tour, presave, and music links, all run by or on behalf of Whitey Morgan Music. We refer to all of these together as our “Sites.”
Some third-party platforms and tools we use or link to from the Sites, such as Shopify, Laylo, Bandsintown, Feature.fm, and Meta, may also collect data for their own purposes. In those cases, that platform’s own privacy policy applies to its independent collection and use of data. We do our best to work with companies we trust to collect and use data about you responsibly, but please read their privacy policies to understand how they will handle your data.
If you have questions or concerns about this privacy policy or our data practices, or want to make a privacy request, contact us at:
We collect and use data about you as described here. Some data may be optional. The uses described here may be subject to your consent or other choices, as required by privacy laws or other legal requirements.
Our website lets you choose how you hear from us: by email or by text message. Both signups run on our Laylo signup page (laylo.com/whiteymorgan). You give only the contact detail for the option you pick.

Buying from our store doesn’t sign you up for marketing emails or texts. Store customers only get them if they choose to sign up, and new email signups are asked to confirm their address. We don’t currently offer text-message signup at checkout.
When you sign up on our Laylo page, you agree to receive recurring automated marketing messages at the phone number or email address you give, and you agree to Laylo’s Terms of Service (https://laylo.com/terms), Cookie Policy (https://laylo.com/cookies), and Privacy Policy (https://laylo.com/privacy). Signing up is never a condition of buying anything. Our text program is also covered by the text-message program terms in our Terms of Use.
In addition to the above, we may use any data collected about you to manage your rights and choices, comply with legal or regulatory obligations, resolve disputes and enforce our agreements, secure our Sites, prevent fraud or other misuse, and protect the safety of our fans and customers.
For individuals in the European Economic Area or United Kingdom, our legal bases for processing are:
Our fan lists are our own data. The email addresses, phone numbers, and other details that fans and customers share with us are Whitey Morgan Music’s own data. We never sell or rent our fan lists, and the vendors listed below only process them for us. We use some standard data practices that are considered a “sale” or “sharing” of personal information under certain laws, including the California Consumer Privacy Act. These are Meta’s “Custom Audiences” advertising feature and the Meta Pixel on our website and store, which we use to advertise on Facebook and Instagram (see “Advertising on Meta” below). You can opt out as described in “Do Not Sell or Share My Personal Information” below.
Text-message signups. We never sell, rent, or share the mobile phone numbers you give us when you sign up for texts with any third party or affiliate for their own marketing or promotional purposes. Your text-message opt-in consent itself is never sold or shared with any third party. We share text-signup phone numbers only with service providers that run our text program for us, such as Laylo, and with Meta in hashed (scrambled) form, used only to match accounts so we can show our own ads, as described in “Advertising on Meta” below.
If you presave a release or otherwise connect one of our Sites (such as a Feature.fm presave page) with your account on a music service such as Spotify or Apple Music, Feature.fm may access some information from that account, as described in “Information we collect and how we use it” above, and use the connection to complete the action you asked for, such as saving our new music to your library or following us. Feature.fm may share some of that information with us, and we may use it to tell you about new music, to understand our fans, and to create audience segments on Meta.
To remove access to your account, visit the music service and follow its instructions:
You can ask us to delete information we received this way by contacting us as described in “How to contact us” above. You will still need to remove the original permission in the music service, as described above.
Our Sites use cookies, tags, pixels, and similar technologies (“Cookies”). Cookies are small files saved to your browser that help websites work and remember things. We and our service providers use:
The store’s full list of Shopify cookies is in the store’s privacy policy at https://whiteymorgan.myshopify.com/policies/privacy-policy.
We advertise on Facebook and Instagram, which are run by Meta. Some of these ads may be personalized, meaning they are meant to be relevant to you based on your past activity or on information we or Meta have about you. We do this in two ways:
Third parties, including Meta, may use cookies, web beacons, and similar technologies to collect or receive information from our site and store and elsewhere on the internet, and use that information to provide measurement services and target ads.
Who we leave out. We do not include people in our Custom Audiences if they have unsubscribed from our emails or texts, marked our emails as spam, asked us to delete their information, or asked us not to use their information for ads. If you make one of those requests after you’ve already been added to an audience, we will remove you from it. We do not build audiences from information about children under 13 or from sensitive information.
How to opt out of ads:
Most modern browsers include cookie controls, including whether to accept first- or third-party cookies and options to delete cookies. See your browser’s help pages for instructions. You may not be able to use all features of the Sites, like the shopping cart, if you block or delete cookies. General information on cookies can be found at www.allaboutcookies.org.
Do Not Track: there’s no common standard for how websites should respond to browser “Do Not Track” signals, so we don’t currently respond to them.
You may have the right to control how we collect, use, or share information about you, including rights to access, correct, delete, or get a copy of it, to withdraw consent, or to opt out of our processing of data about you.
We will respond as quickly as we can, within the time periods required by applicable law.
Our default rule is that we keep information about you only as long as it is needed for the purpose it was collected for, or for a use described above, or as long as the law requires. We keep your signup information for as long as you stay subscribed, and remove it from marketing when you unsubscribe or ask us to delete it. We keep order records as long as needed for shipping, returns, taxes, accounting, and legal requirements.
We use reputable service providers and take reasonable steps to protect your information. But no website, app, or method of sending data over the internet is 100% secure, so we can’t guarantee absolute security.
We’re based in the United States, and our service providers may store and process your information in the U.S. and other countries.
Our Sites are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Our Laylo signups (texts and emails) are for people 18 and older. If you believe we have collected information about your child, contact us as described in “How to contact us” above and we’ll delete it.
Any material changes we make to this privacy policy will be posted here, and we’ll update the “Effective” date at the top. If we make big changes, we’ll take reasonable steps to let you know (for example, a notice on the site).
Certain local and regional privacy laws require specific disclosures about our data practices.
Depending on where you live (for example, California, Texas, Colorado, Virginia, Montana, and other states with privacy laws), you may have some or all of the following rights, which you can exercise by contacting us as described in “How to contact us” above:
If state privacy laws apply and you live in one of those states, you may also have the right to opt out of profiling that produces legal or similarly significant effects. If the California Consumer Privacy Act applies and you are a California resident, you may have the right to opt out of having your personal information shared with third parties for their own direct marketing purposes.
We collect personal information from:
Appeals. If you’re not satisfied with the result of a privacy rights request, you can appeal our decision by contacting us as described in “How to contact us” above. Please put “Appeal” in the subject line of your email or at the top of your letter.
Verification. We may need to verify your identity before fulfilling your privacy rights request. Verification will depend on the type of request and the risk of disclosing information to the wrong person. Steps may include asking you to reply from the email address you used with us, or to provide other details that support the request.
Authorized agents. You may designate someone else as your agent to make privacy rights requests for you. An agent must be designated in writing or through a power of attorney, and we will ask the agent to show proof of their authority before we act on the request.
You have the right to opt out of the “sale” of your personal information, or the “sharing” of your personal information for cross-context behavioral (targeted) advertising, including our use of Meta Custom Audiences and the Meta Pixel. To opt out, email us at merch@truegritmanagement.com or write to us at Whitey Morgan Music, PO Box 6009, Bozeman, MT 59771, with “Do Not Sell or Share” in the subject line or at the top of your letter, or use the “Do Not Sell or Share My Personal Information” link on our website.
If you are in the European Economic Area or the United Kingdom, you may have additional rights regarding our processing of personal data about you. You may have the right to:
Our legal bases for processing are listed in “Information we collect and how we use it” above. If you believe our processing of personal data about you does not comply with applicable laws, you may also have the right to lodge a complaint with your local data protection authority.
We do not use your personal data for automated decision-making that has legal or similarly significant effects on you.
Our processing of your personal data may require transferring it outside the European Economic Area and United Kingdom, mainly to the United States. When that happens, we take steps to apply approved safeguards, usually through approved data transfer agreements.
